To all of you reading this, this is not done. I just wanted to post something to show where I am going with this. I have gotten some limited feedback and this will help to clarify things. The Rights of the People is a moral and legal code of ethical conduct. The economic system is not capitalism, socialism or communism. Terran Society is not a commune and is not dependent on only like minded people. It is intended for all people of Terra to join on a voluntary basis. A plan like this has not been tried before. This is an experiment, but only in the sense of being new. But it is a logical evolution of what we have learned so far. There are no new secrets of how a system of governance can be corrupted. This is an attempt to prevent social decay and provide the flexibility to form an advanced civilization, a Human Centric Civilization!

If you have some suggestions, kind of expecting some good ones, feel free to participate. Also, we still have to figure out how to add new members.

I have serious IT skills and my son and I have serious Cooking skills. There is a fairly detailed business plan for Infodine as an Information Technology company and we have developed several recipies that are high-end good without gluten, soy, corn, wheat, GMO, milk and most are vegetarian or vegan. We have decades of food service experience. We want to get this off the ground by getting our two business plans up and running. So initially, I was thinking new members might be part of those two cooperatives.

Organizational Outline

Basic Principals of Terran Society

Terran Society operations need to be open, transparent and accessible to the People as the base of power is the informed individual.

Terran Society services and systems must be designed, developed and administered for the benefit of all members of the society.

We, the People, are caretakers of this wonderful world and hold it in deep respect. This will be shown in our policies, laws, new development, resource use and extraction, cultivation, exploration and environmental clean-up.

Services provided to Regions within Terran Society must be administered equally per Region and per Member.

Permanent structures & facilities must be designed to last for future generations, have minimal maintenance and be as energy independent and efficient as is practical.

Terran Society services are for members and guests.

Each Terran community and region should be self-sufficient in a sustainable way for meeting their basic needs.

Air, water and land cannot be owned. Use of resources will be managed with respect for the ecosystem and Terran Society.

Members may serve in only one branch of Terran Society or the military at the same time. A choice must be made publicly when this situation occurs.

Voting rights cannot be revoked as punishment or penalty to prevent disenfranchisement of individuals within Terran Society.

Terran Society Members do not have to have a formal legal name. A reliable form of non-invasive bio-metric identification, as determined by the Terran Legislature, shall be used to match a member to their account and access services.

The Terran Society financial account for each Member's stipend allocations may not be stopped, locked or encumbered as punishment or penalty as long as they remain a member.

Rights of the People

We are endowed by our Creator with certain in-alienable Rights, among these are Life, Liberty and the Pursuit of Happiness. The Rights listed here are a restriction on government, institutions, organizations and individuals. Furthermore, it is the duty of government and the people to protect these Rights as a matter of Terran Security.

#01  Each Person is a unique individual, therefore all People have a Right to their own beliefs, thoughts emotions and free expression thereof, including in the Public Space.

#02  People have the right to freedom of speech through voice, song, writing or other art of self expression. However, a Person can be held accountable if their speech or self expression directly causes physical harm or violates the Rights of another person.

#03  People have the right to choose their final exit from the physical body as they deem appropriate, as long as the rights of others are respected.

#04  A pregnant woman has the right to determine the course of her own pregnancy.

#05  People retain the Right to their body and therefore control of the consumption and use of foods and medicines. This includes the right to be free of forced medication, implantation, injection, medical procedure, poison or otherwise be harmed. Children have the Right to not be sexually mutilated.

#06  People have the Right to adorn, dress or not and present themselves as they see fit.

#07  As Humans, we have a symbiotic relationship with the cannabis plant, the only known plant which by itself can sustain Human life and civilization. People have the right to possess, grow, use and have access to cannabis.

#08  As Humans we share a relationship with all life of which our Terran Biosphere is composed and have a natural right to responsibly use, cultivate and/or farm animals, plants, fungi, algae and such.

#09  People have the Right to be free of harmful substances added to food, water, air and soil and other environmental pollution.

#10  People have the Right to a healthy and safe living, working and playing environment as is practical. But they may choose to take risks upon themselves or participate in activities which can never be totally free of danger or potential harm.

#11  People have the Right to peaceably assemble.

#12  People have a Right to access and/or use Public Space without fee or registration.

#13  People have the Right to Travel as is practical. Public roads and public forms of transportation must be available to all.

#14  People have the right to be secure in their person, home, papers, thoughts, digital media, effects and private communications, against unreasonable search and/or seizure.

#15  People have a Right to self defense and to defend others if necessary. Therefore People have the right to keep and bear arms and learn martial arts. This is does not include the use of excessive force. Weapons of mass destruction, need to be under secure military control.

#16  People have the right to be quiet and to not accuse themselves. Forced confession and attempted forced confession is forbidden.

#17  A Person shall be free from double jeopardy. That is we cannot be accused and a hearing held more than once for the same offense. A single act cannot result in multiple charges. One charge has to be chosen.

#18  A Person may be accused and brought to trial only for acts which have violated the Rights of another Person. There has to be an actual injured party. Entrapment and sting operations are crimes in and of themselves and the injured party is their target.

#19  A mother and father will have joint custody of their children, even in a break-up, unless they agree to another arrangement between themselves or through a mediator.

#20  People cannot be property. Involuntary servitude, including taxation of an individuals labor or services rendered is prohibited.

#21  Chromosomes, genes and genetically engineered life forms are not private intellectual property and may not be patented.

#22  A legally defined organization of people is not a person and cannot have legal standing as an actual person.

#23  People have the Right to contract freely with others as long as the enforcement of that contract or agreement does not result in harm to the individual. Therefore, People have the Right to terminate their consent to a contract or agreement. If a contract results in harm, or is expected to harm the individual, that agreement may be invalidated immediately.

#24  People have the Right to full disclosure of information regarding organizational structure, roles and responsibilities from any organization they participate in or public organizational body created to meet the needs of a community.

#25  People have the right to access any data or information collected or stored about themselves by any person, group or organization. This includes the right to challenge, amend and/or correct such information.

#26  A duly appointed body created by community consensus may have only the powers specifically granted to it. No group or organization may be granted powers which result in the violation of the Rights of the People.

#27  If any Citizen shall accept, claim, receive, or retain any title of nobility or honor, or accept and retain any present, pension, office, or emolument, from any emperor, king, prince, or foreign power, such person shall be ineligible to hold any office of public trust within this Society to avoid conflict of loyalty.

#28  No single law created by any elected legislature can be too long or complex. If it takes more than 20 minutes for a person of average reading ability to read and/or is not in clear, understandable language, that law is null and void.

#29  Any person elected or appointed to office who violates this Bill of Rights is subject to recall and a new election held for their office or legislative seat as soon as is practical.

#30  Truthful authorship of any pending law or treaty has to be made public before any binding vote for approval can take place.

#31  No law or treaty can be valid which has not been made public and read aloud in the legislature with a quorum present, at least three times and these readings spaced apart in time at least one day, before being voted on for approval.

#32  No treaty or binding agreement with a party outside this Society may be made by any representative person or group in the name of this Society which violates these Rights. Any treaties or binding agreements made with a party outside this Society must be made public and subject to a vote for approval by the entire Terran community with a two thirds majority before it can take effect.

#33  This defining of certain rights, shall not be construed to deny or disparage others retained by the People.

Terran Society Management Structure

The overall purpose of this Consititution is to define a framework for Terran Society to function as an advanced civilization and protect the Rights of the People.

Terran Society management consists of four branches, each fulfilling a different role. These are the Executive, Legislative, Court System and Fair Witness Branches. This structure provides for authoritative roles for effectiveness, yet prevents undue concentrations of power.

This system is open-ended and adaptable to all Terrans. The Rights of the People are a guide to how we interact with each other and non-members as well.

Terran Executive Branch

The Executive Branch has overall responsibility for the day to day administration of Terran Society services and operations. The Executive Branch consists of the Executive Committee and as many Councils of Elders as necessary by population. The Executive Committee is made up of the elected heads of five executive offices. The offices of Sheriff, Treasurer, Environmental Guardian, Administrator and Ambassador.

These are elected offices with separate departments and management structures. Their roles require expertise and specialization. The election process and the Fair Witness branch will ensure openness, merit and accountability.

Most services are provided through the Regional executive departments and Chartered Public Cooperatives.

The Terran Executive Branch is responsible for:

  Implementing processes, organizations and infrastructure projects as per appropriate legislation.

  Large scale projects which need coordination with multiple Regions.

  Subterranean, Undersea, Terrestrial, Inter-dimensional and Space Exploration.

  Facilitate trade, travel and commerce with other civilizations.

Elected Offices of the Terran Executive Branch

Terran Executive Committee

Consists of the Terran Administrator, Treasurer, Ambassador, Sheriff and Environmental Guardian.

Shall hold status meetings on a weekly basis with daily communication and coordination.

Executive Committee meetings require the presence of a Certified Fair Witness.

The Leader of the Executive Committee shall change bi-weekly with each Officer taking turns on a rotational basis.

All reports sent to the Terran Legislative Councils by the Offices of the Terran Executive Branch shall be copied to the Executive Committee.

Responsibilities of the Terran Executive Committee include:

  Primary civilian oversight of the Military.

  Each of the office holders must vote to veto or pass legislation with a simple majority passing.

  Report to and maintain liason with both Councils of the Terran Legislature.

  Approve or Veto a Treaty before sending it to the Terran Legislature. A majority vote approves.

Terran Administrator

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Senior Administrator of the Executive Branch of the Terran Management, its services, Operations and facilities not delegated to the Office of Ambassador, Treasurer, Sheriff or Environmental Guardian.

Appoints Senior Military Officer pending approval of the Planetary Legislative Senate.

Primary civilian oversight of the Military.

Administer Terran Government Operations and Services not under the authority of the other Executive Branch elected offices.

Conduct a census every nine years to update Member information.

Maintain

Terran Treasurer

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Treasurer of Terran Society.

Manage Terran Society financial accounts, monies, payments and allocations and maintain correct accounting.

Develop and maintain a smooth system for Members to receive their basic stipend from the Treasury. This includes maintaining an accessible financial account for each Member of Terran Society.

Ensure Member payments are received correctly as per legislation.

Has authority to audit Terran Society Charted Cooperatives. Regular and correct reports shall be made to the Treasurer by all business entities within Terran Society.

Terran Sheriff

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Senior Executive for all Terran level Sheriff operations.

A Sheriff Officer must be present at Terran Major Court hearings.

Enforce valid search and arrest warrants.

Inter-Regional criminal investigation authority, using technology as practical.

Responsible for coordination with the Regional Sheriff departments for Inter-Regional crime and investigation.

Identify and promote best practices across Regional Sheriff departments.

Liaison with other civilization's police authority. A treaty is not required for the Terran Sheriff to coordinate with other civilizations regarding criminal investigations. However, when a treaty exists, that coordination shall be made in accordance with the treaty. Coordination with other civilizations in criminal investigation is subject to the approval of the Terran Ambassador and shall be conducted through an appropriate Embassy when possible.

Respond to emergency situations within Terran Society management and areas outside of Regional jurisdiction.

All Terran and Regional Sheriff Officers shall:

  Be respectful of the Rights of the People, avoid harm and not use excessive force.

  Have training and certification in First Aid and Cardiopulmonary Resuscitation (CPR).

  Have training and certification in self defense and learn how to safely disarm a person when necessary.

  Have training and certification in the use, maintenance and marksmanship of any weapon used or carried in the line of duty.

  Maintain good physical condition with some time scheduled in each workday for physical fitness.

  Strive to keep the peace and protect the People from rights violations.

Terran Ambassador

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Senior Diplomat and Trade Representative from Terran Society to other civilizations.

Appoints Ambassadors to other Civilizations subject to approval of the Terran Council of the Regions.

Hosts foreign dignitaries and official envoys.

Coordinates and manages of all embassies, embassy staff and services.

Facilitates embassy communications and communications security.

Coordinates with the Military Council to protect and secure embassies.

Maintain consultation and liason with both Councils of the Terran Legislature regarding foreign relations.

Provide information, assistance and emergency aid to Terran's traveling outside of Terran Society.

Facilitate good trade relations.

Find creative ways to improve infrastructure or quality of life as a gift of Terran Society to friendly civilizations.

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Terran Environmental Guardian

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Senior Executive for all Terran level environmental protection and restoration operations.

The Office of Environment shall study environmental issues. Pro-actively test for pollution and environmental damage. Develop and evaluate techniques, methods and technology to clean up polluted areas and restore a natural ecology.

It may be impossible to prevent the creation, in practical terms, of toxic substances. But these toxic substances must be rendered stable or broken down to safe components before release into our natural environment.

Protecting the Natural Environment is not intended to stop extraction of natural resources, but to make such extraction conform to standards which are respectful of life.

Receive and review environmental concern reports from Members which may result in further investigation.

Initiate and Conduct environmental investigations to determine the cause of the environmental problem. If appropriate, determine a plan for repair and restoration. Implement that plan.

First point of dispute resolution regarding resources between Regions.

Coordinate global resources such as ocean fishing management for example, based on legislation and objective criteria.

Responsible for Environmental Protection in areas of this planet outside of any Local Government Area.

Pro-actively test and monitor for environmental pollution.

Consolidate environmental monitoring data collected by Regional Environmental Protectors. Ensure all Members have access to this information.

Ensure weather modification technology, if used at all, is applied in the best interest of all. For example, directing destructive storms away from population centers and are reducing storm intensity. Potential beneficial use includes drought relief or to make arid land fertile again.

Facilitate communication with and between Regions.

Encourage and develop friendly competitions designed to improve operational performance involving all Regions.

Terran Council of Elders

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

As the Regional Council of Elders’ primary role is to peacefully resolve family and child problem situations. They shall maintain a safe haven for a child or other family member to go to temporarily in a crisis. The Council's operational goal is healing the problem and restoring the family unit. This may include providing counsel and guidance to families in need.

The Regional Council of Elders is responsible for the care of orphaned children and adoption. Adoption records shall remain open. Fee or payment of any kind is not allowed in the matter of adoption.

The Regional Council of Elders shall help People who are struggling to adapt to Terran Society.

The Council of Elders may hear issues people may wish to bring to them and the Council is willing to consider. Issues not resolved may escalate to the Court System, the Legislature or the Sheriff.

Terran Legislative Branch

The Legislature will craft rules and regulations, approve budgets, and develop the models for our various kinds of chartered cooperatives.

All acts written to be voted on in any Terran Council, must conform to the Rights of the People.

Each Legislative body has authority to appoint its officers, create sub-committees and set its rules of operation.

All hearings must be public or the proceeding published or made public soon after.

Legislative sessions are null and void without the presence of the Certified Fair Witness to observe and record the sessions.

Each Legislative body has authority to conduct investigative hearings relative to their jurisdictions, and compel witnesses to appear.

The Council of the People has the authority to impeach any elected member of the Executive branch, Court System branch or Fair Witness branch for cause as per this Constitution and legislation. The Terran Council of the Regions will hold the hearing and make the finding for members of the Terran government.

Coordinate access to natural resources where those resources are between or across Regions working with concerned parties for a fair balance.

Each Legislative body is responsible for budget and resource allocation within their jurisdiction.

The Legislature has authority to set rules for and authorization of Chartered Organizations within their jurisdictions.

The Terran and Regional Councils of the People have authority to define representative districts for seats in the Council.

Shares military oversight with Office of Administrator and budget allocation.

Standards of weights, measures and time keeping. This includes setting up a new calendar.

Laws which define the details of the Governmental Structure and Procedure.

Planetary Terran Infrastructure and Projects outside the scope of Regional Government.

Set common standards for intra-regional Commerce.

Charter organizations whose primary operations are in subterranean, off world or undersea or which provide services on a scale beyond the scope of Regional Government.

Authorize currency creation on an annual, bi-annual or tri-annual basis.

Define the criteria and process for emergency limited military assistance to law enforcement.

Coordinate access to natural resources where those resources are between or across Regions working with concerned parties for a fair balance.

Terran Council of the Regions

Represents the Regional Governments.

Candidates will have been nominated by the Regional First Executive and voted for approval by the Regional Legislature and must serve a six year term.

Each Region will have two seats on the Council of the Regions, regardless of their populations.

One of the two seats will be up for appointment every three years alternately. Appointment to this body will occur 30 days prior to the standard election cycle. The reasoning is officials will have had three years to know more what is going on. Provides stability and continuity.

Hold impeachment hearings of the elected offices of the Planetary Executive and Court System branch.

Must approve or not any legislation passed to it after approval by the Planetary Council of Representatives.

Approval of Treaties drafted and approved by the First Executive by a two thirds majority before sending to the Terran Council of the People.

Terran Council of the People

This Council will represent the People with one seat for a specified number of eligible voting Members. The number of seats may change with each election cycle if the voting population changes. The number of people per district initally will simply be 25, but may scale up to 2.5 million.

All spending laws must originate with the Council of the People.

Vote for approval of Treaties with a simple majory, which have been approved by the Council of the Regions. The approved treaty is then put to a vote of the general electorate.

Terran Councilor of the Regions

Each term is for six years.

A Person is limited to serving a maximum of 19 years or three terms of service in this Office.

Terran Councilor of the People

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Terran Court System Branch

The Terran Court System is intended to provide peaceful dispute resolution. The objective is justice within the law.

The Court System must be transparent and open to the public. Secret hearings, evidence or testimony is not allowed.

A Jury has authority to nullify a law and determine if the application of a law in a given case is in-appropriate or unjust.

Only actual violations of the Rights of the People and an 'injured party' can result in having to defend oneself in court.

Terran Regional Court

The Conductor of the Court is elected by sitting Conductors of the Court from the Local Government level. The nominee must have served at least one full term as a Conductor of the Court for a Regional Government. The nominee does not have to be currently serving.

Three Certified Fair Witnesses must be in attendance for a session to occur.

The parties in a Terran Major Court will be representatives of the Executive Branch of a Local Area Government. It is not a criminal court. It is intended for dispute resolution between Regional Governments.

In this court, disputes between Terran Society and Outside parties may receive a public hearing. These may be non Humans Being, other civilizations or governments.

The Jury Panel will be selected from Citizens who have served at least one term in the Terran Council of the People or Council of the Regions.

The Jury Panel consists of twenty one Jurors and seven Alternates.

A majority of the Jurors must be in agreement to resolve the case. This result is binding on the parties involved, including Terran and Regional Governments.

If the matter is not resolved in this court, then a hearing may be granted in the Councils of the People or Regions.

Primary criteria of electing a Conductor of the Terran Major Court is a strong sense of fairness and diplomatic skill.

There has to be actual Law, Rights or Treaty Violation to bring the parties to court. Else, the Councils of the People and Regions would be the proper venue for a hearing.

If, as a result of the hearing a Treaty or Treaty modification is determined to be the best solution, then the case is brought to the Office of Ambassador for review and action.

Terran Fair Witness Branch

This fourth part of the governmental structure is a check on government. The independence of the Fair Witness branch of government will provide credibility, fairness and openness.

The Certified Fair Witness role is as observers within government and public cooperatives. This requires unrestricted access to the Executive, Legislative and Court System branches of Terran and Regional Governments, and to chartered public service/utility cooperatives.

The Fair Witness Branch of Government to create and maintain records, logs, meeting minutes, and other data collection.

A Certified Fair Witness shall be present in and have access to:

Offices, facilities and managerial meetings of the the Executive Branch

Court System hearings and jury deliberations.

Legislative sessions, subcommittee meetings, hearings and official events.

Each assembly of a Council of Elders.

Board Meeting and other meetings deemed significant within Public Cooperatives.

Certified Fair Witnesses will be assigned administrative access to all government and public cooperative's data systems with the authority to audit and create reports.

After collecting public records, it is the duty of the Fair Witness Branch to create and maintain a library of public records and make this information available to all members of Terran Society. This information is not for publication outside of Terran Society.

Individuals are to be trained, tested and certified to be impartial, non-bias witnesses. Their training and testing will be difficult to complete. They shall be taught to be honest and keen observers. Their language will be clear and objective without assumption or subjectivity. They shall be trusted to be truthful.

The Fair Witness Branch required to be fluent in all of the major languages used in government and Korean. They will become linguistic masters.

Fair Witnesses are not police, while their work may support criminal investigations, they do not conduct them. A Fair Witness may answer questions, provide information and inform the electorate.

It is a criminal act to compromise or control a Certified Fair Witness. This is a crime where the whole Region or Society is the victim.

Certified Fair Witnesses are not required to perform any other kind of work or public service as long as they keep their Certification.

Certified Fair Witness is the only designated group with such a protective, privileged status.

Terran Fair Witness Trainee

Qualified persons accepted into the training phase. This phase is complete upon passing all required course work and tests for such a demanding role.

Prior service in any branch of government is not a requirement to become a Trainee.

Graduation of the Fair Witness Training Program will be held at a public ceremony.

Terran Fair Witness Apprentice

Upon graduation, Apprentices will be assigned to a Certified Fair Witness for a period of time to learn and gain experience.

The duration of this phase and criteria to be met will set by the Terran Fair Witness Panel.

The Mentor will report to the appropriate panel when the Apprentice is ready for Certification.

Certification of Fair Witnesses who have completed their Apprenticeship will be held at a public ceremony.

Terran Certified Fair Witness (CFW)

A CFW will have full rights and privileges to assume their role in Terran Society. They will be trusted to be objective and honestly report on and record the business of government.

A CFW has full access to the Executive, Court System and Legislative branches of government and Public Service Cooperatives.

May be assigned and reassigned to the Terran or any Regional government.

Senior Certified Fair Witness (SCFW)

Management level. Maintains the public Libraries and other channels for storage and dissemination of information to all members of Terran Society. Day to day administration, including management of infrastructure, operations and support staff.

Eligible for election to a Fair Witness Council.

Relieved of CFW duty except as needs require or to temporarily fill a position pending assignment by a CFW.

A CFW is eligible to apply for this level after a period of service as specified by the Terran Fair Witness Council. Acceptance to Senior Certified Fair Witness status must be based on merit.

Receive further education as appropriate for assigned responsibilities as with all Terran and Regional government personnel.

Relieved of CFW duty except as needs require or to temporarily fill a position pending assignment by a CFW.

May be assigned and reassigned to the Terran or any Regional government.

Reprimand or Recall of a Certified Fair Witness

Fair Witnesses, including panel members will be subject to recall in this manner:

A complaint of breach of trust or compromise is made to the appropriate Fair Witness Panel.

A Complaint may be initiated or endorsed by any Citizen of the Terran Society, the Terran or a Regional Office of Administration, or any member of the Terran or a Regional Council of the People.

If the matter is not resolved to the satisfaction of the person(s) filing the complaint by the Fair Witness Panel within 30 days, then proceeding for removal of certification are as follows:

After a hearing, the appropriate Regional Council of the People may vote to remove certification. With a majority vote, the resolution is sent to the appropriate Regional Executive Committee for approval. If the Executive Committee vetoes the resolution, a two-thirds vote of the Council of the People may over-ride the veto.

Terran Military

A Society unwilling to use force when necessary to defend itself it is unlikely to exist for very long. Readiness is material preparedness. Vigilance is a state of being. Fast response is skill. Readiness, vigilance and fast response are critical and can only be achieved though being prepared, training and practice. Therefore, Terran Society establishes a single Military branch of government to be defined by the Terran Councils of the People and Regions and the Terran Office of Administration.

The Terran Military Civilian governments do not have authority to initiate a war of aggression.

The Terran Councils of the People and Regions may designate military service awards and medals and set objective criteria for their achievement.

The Terran Council of the People and Regions may award medals by a majority vote.

Terran Military Council

The senior command of the Terran Military is the Terran Military Council.

The Council Leader, is elected by majority vote. While a new vote may be called for at any time, the role of Council Leader is subject to a vote for renewal held after each year of service. If renewal is not approved, a new Council Leader is elected.

Five of the nine members of the Military Council will be nominated for appointment by the Terran Executive subject to majority approval by the Terran Council of the Regions. Each elected official, the Terran Administrator, Treasurer, Sheriff, Ambassador and Environmental Protector will nominate one member. Nominations are subject majority approval by the Terran Council of the Regions. Nominees are selected from the two highest levels of Rank.

The senior officer’s of the two highest levels of Rank will elect from among themselves, four of the nine members of the Military Council.

The Military Council will maintain liaison with the Terran Executive committee and the Councils of the Regions and People.

Civilian Control

Resource and budget allocation for the Terran Military will be determined by the Terran Councils of the People and Regions subject to the legislative process. The Terran Military budget is part of the overall Terran budget.

Force Structure

History has demonstrated that a large standing military in time of peace has potential for abusing the Rights of the People. But a large population of trained veterans is also the best defense. Therefore, the Terran Military will be structured to have a minimal active duty force with a large reserve contingent of veterans who may be called to active duty in time of need.

The Terran Military will define its organizational and operational unit structures, roles and responsibilities and present this to the Terran Office of Administrator and the Councils of the People and Regions.

The Terran Councils of the People and Regions must craft legislation for designation of rank title, insignia, specialization, uniform styles and colors. Proposals will be presented by military staff and individual members of Terran Society to the Terran Council of the People.

The Terran Military shall consist of an all Volunteer Force, have a Unified Organization Structure and a Single Order of Rank. Recruitment shall be proportional across Regional Governments.

The Terran Councils of the People and Regions are tasked with crafting legislation for designation of rank, insignia, specialization, uniform styles and colors. Proposals will be presented by military staff, Office of Administrator and individuals to the Terran Council of the People.

Promotion and role assignment must be based on merit, respect from peers with pre-defined objective goals.

Training for qualifications and certifications will be ongoing throughout an individual’s military service.

Military Secrecy

The Military needs secrets, especially in planning, communications and operational security. However, Military leaders must balance the ‘Need to Know’ with ‘Right to Know’ and ‘Duty to Inform’.

Emergency Response

The Legislature shall define effective rules governing authority and scope for a limited response to an immediate threat.

In the event of a response to an immediate threat, the Military Council shall meet and be informed to determine options and recommend a course of action. The Supreme Military Council will inform the Terran Executive Offices and the Legislative Councils.

Declaration of War

War is forbidden except in defense of Terran Society and Terra. If war becomes a necessary rational course of action, a Declaration of War shall be prepared by the Executive Committee in consultation with the Military Council.

Upon a vote for approval by the Terran Executive Committee and the Military Council, the Declaration will be presented to the Terran Legislature. The Council of the Regions shall vote on the declaration. Upon approval by majority vote, The Council of the People will then vote on the Declaration. Approval by majority vote enacts the Declaration.

Military Intelligence

Terran Military Intelligence is responsible for intelligence collection and analysis relative to the defense of our Society and Terra. Military Intelligence’s primary role is to provide information to support planning, training and execution of military operations in defense of Terran Society and the Rights of the People.

Responsibilities include anticipation of risk, threat and vulnerability from other civilizations. This includes monitoring of communications and force movements for threat analysis.

Law Enforcement

The military may only assist law enforcement in matters of Terran Security and as defined by the Terran Councils of the People and Regions through the legislative process. Such a provision may be put into operation only under public awareness and observation.

Members of the Terran Military are entitled to the same rights as non-military members of Terran Society.

Reporting Official Misconduct

A member of the Terran Military may report official misconduct to the Terran Office of Administrator, a Terran or Regional Sheriff and elected members of the Terran or Regional Councils. Follow-up investigations may be conducted by the Terran Office of Administration or Terran Sheriff and hearings held by the Terran Council of the People. Criminal cases will be referred to and handled by the Regional Court System where the incident occurred.

Prisoners of War

All military and civilian prisoners captured in war or defensive conflict, if such a situation occurs, are the responsibility of the civilian government, specifically the Offices of the Administrator.

Prisoners shall be held in humane conditions and their basic needs met.

Prisoners will be introduced to our Constitution.

War Closure

All wars need to end. The Office of Ambassador is tasked with negotiations and to develop plans for a peace settlement. No plan may include a violation of the Rights of the People.

Regional Management

Regional management is representative of the Members of Terran Society within a defined geographical area. All Member are associated with a Region.

An open Region shall be created for members who are spread out and not associated with a localized Region.

A separate Region shall be created to hold the capitol of Terran Society.

Naming

Correctly naming the Regional Government is important. Existing regional names may be selected as per the will of the people. The name should reflect the identity of the geographical region. The legislature will hold public hearings and prepare a public referendum. The referendum will be held to select the name of the Regional Government. Through this process a Regional Government may also change its name.

Size

The size in population should not exceed 20,000,000 or be fewer than 2,000,000 for starting guidelines. Metropolitan areas larger than this may want to form a single Regional Government. Over time, experience, practicality, public discourse and legislative debate will objectively define proper population ratios.

Boundaries

It is the responsibility of the Planetary Legislature in coordination with the people of the area to determine boundaries on a practical basis.

Subdivision

When a Regional Government gets too large, it may divide into two or more Regional Governments with a majority vote by the residents or a two thirds vote of approval by the Regional Council of the People.

Regional Executive Branch

Elected Offices of the Terran Executive Branch

Regional Executive Committee

Consists of the Regional Administrator, Treasurer, Ambassador, Sheriff and Environmental Guardian.

Shall hold status meetings on a weekly basis with daily communication and coordination.

Executive Committee meetings require the presence of a Certified Fair Witness.

The Leader of the Executive Committee shall change bi-weekly with each Officer taking turns on a rotational basis.

All reports sent to the Terran Legislative Councils by the Offices of the Terran Executive Branch shall be copied to the Executive Committee.

Responsibilities of the Terran Executive Committee include:

  Primary civilian oversight of the Military.

  Each of the office holders must vote to veto or pass legislation with a simple majority passing.

  Report to and maintain liason with both Councils of the Terran Legislature.

  Approve or Veto a Treaty before sending it to the Terran Legislature. A majority vote approves.

Regional Administrator

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Administrator of the Regional Government's services, facilities and operations.

Recommends candidates for the Council of the Regions to the Regional Legislature for approval when one of their terms is up.

Shall maintain accessibility to the People to administer and provide Regional Services.

Regional Treasurer

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Maintains the Regional Treasury including management of public accounts and revenue for the Regional Government.

Administers taxation and collection as defined by legislation for the public Treasury.

Regional Ambassador

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Regional Sheriff

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Responsible for protecting the of the Rights of the People within the Region.

Conducts criminal investigations within the Regional Jurisdiction.

Shall maintain accessibility to the People within the Region to receive crime reports and emergency calls.

Shall maintain the ability to respond to emergency calls and criminal activity.

Coordinates with the Terran Sheriff in matters involving inter-regional crime.

Shall provide protection, if necessary, to Members who report official misconduct or serious crime.

Regional Environmental Guardian

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Senior Executive for Region level environmental protection and restoration operations.

The Office of Environment shall study environmental issues. Pro-actively test for pollution and environmental damage. Develop and evaluate techniques, methods and technology to clean up polluted areas and restore a natural ecology.

It may be impossible to prevent the creation, in practical terms, of toxic substances. But these toxic substances must be rendered stable or broken down to safe components before release into our natural environment.

Protecting the Natural Environment is not intended to stop extraction of natural resources, but to make such extraction conform to standards which are respectful of life.

Receive and review environmental concern reports from Members which may result in further investigation.

Initiate and Conduct environmental investigations to determine the cause of the environmental problem. If appropriate, determine a plan for repair and restoration. Implement that plan.

First point of dispute resolution regarding resources within the Region.

Coordinate regional resources based on legislation and objective criteria.

Pro-actively test and monitor for environmental pollution.

Consolidate environmental monitoring data collected within the Region and pass reports on to the Terran Environmental Guardian.

Encourage and develop friendly competitions designed to improve operational performance within the Region.

Shall study environmental issues and the eccosystem for understanding to develop our society with minimal negative impact.

Pro-actively test for and monitor environmental pollution and damage.

Develop techniques, methods and technology to clean up polluted areas and restore a natural ecology.

Provide information, educational, and if necessary technical assistance to organizations with environmental impact issues to help them implement processes and technology to reduce or eliminate pollution within the Region.

Regional Councils of Elders

Elders will serve a three year term with one-third (1/3) up for election on an annual cycle.

There are no term limits.

Criteria to serve on the Regional Council of Elders include compassion and love for children.

The Regional Council of Elders’ primary role is to peacefully resolve family and child problem situations. They shall maintain a safe haven for a child or other family member to go to temporarily in a crisis. The Council's operational goal is healing the problem and restoring the family unit. This may include providing counsel and guidance to families in need.

The Regional Council of Elders is responsible for the care of orphaned children and adoption. Adoption records shall remain open. Fee or payment of any kind is not allowed in the matter of adoption.

The Regional Council of Elders shall help People who are struggling to adapt to Terran Society.

The Regional Council of Elders may hear issues people may wish to bring to them and the Council is willing to consider. Issues not resolved may escalate to the Court System, the Legislature or the Sheriff.

Jurisdictional boundaries, number of elected Elders per population, budget allocation and other details shall be determined by the Regional Legislature and the legislative process. Initially district size shall be 5,000 to 21,000 people. Each Council of Elder shall have a minimum of three seats. An additional seat is added for each additional three thousand people after 9,000.

It is preferable for candidates to be at least 50 years of age.

Regional Legislative Branch

Regional Council of the People

Define rules for and the structure of Chartered Organizations within their Regional Government.

The Houses of Representatives have authority to define representative districts for seats in the Council. These districts must be simple defined areas, not contorted districts.

Members will be directly elected with one representative per 50,000 adult Citizens. The number of seats may change with each election cycle based on demographics.

The ratio of representation cannot be changed by legislation but by the Constitutional Amendment process.

The elections will take place every three years on the normal election cycle.

The entire Council will be up for election at each cycle.

This legislative body is charged to work with each independent office of the Executive branch to develop and pass budget legislation. Budget cycles may be annual, bi-annual or tri-annual as determined by the Terran and each Regional Legislature.

Major office appointments by the Regional Office of Administrator may be subject to the approval of the Regional Council of the People.

The Regional Council of the People has authority to impeach any elected member of the Regional Executive, Court System or Fair Witness Branch for cause. When a determination is made for an impeachment, it takes high priority in the order of business and is put to a vote. If the vote is for impeachment, the Terran Council of the Regions will hold the impeachment hearing. At the conclusion of the hearing, the Council of the People shall vote to remove the person from office and an interim election held or not.

The Houses of Representatives has authority to define representative districts for seats in the Council. These districts must be simple defined, not contorted.

Regional Councilor of the People

Each term is for three years with elections on the standard cycle.

A person is limited to serving a maximum of 10 years or three terms of service in this Office.

Primary Representative of the People.

Shall be accessable to the People in their district.

Receives reports of official misconduct of within the Military, Terran or Regional level Terran Society management.

Shall provide protection, if necessary, to whistleblowers who report official misconduct or serious crimes.

Regional Court System Branch

Conductors of the Court and Public Arbitrators will be in charge of the Court process and conducting hearings.

A Certified Fair Witness will be assigned to each Major, Minor and Arbitrtion Court and must be present for any proceeding to take place.

Charges must be based on Rights violations with actual injured person or people, this includes personal property and organizational property.

The Regional Legislature defines what constitutes a major or minor violation.

The Regional Legislature may specify a maximum and minimum penalty for a given crime.

Major and Minor Court

Each Major and Minor Court will have:

A Sheriff to support the Conductor of the Courts and enforce the decision of the Jury.

A Upholder of Rights to present charges, supporting evidence and testimony.

One defendant per hearing and their designated counsel.

Regional Major Court

For a Person charged with a serious offense, which could result in serious penalty and/or restitution.

A Major Court Jury consists of fourteen (14) Members and three (3) alternates. The alternates would only vote in a replacement role. This is to cover dismissals and excused absences like a medical or family emergency.

A vote of twelve (12) out of the fourteen (14) members is required to find the accusations made of the defendant are valid.

Regional Minor Court

For a Person charged with a minor offense, which could result in minor penalty and/or restitution.

A Minor Court Jury consists of seven (7) Members and two(2) alternates.

A vote of six (6) of the seven (7) members is required to find the accusations made of the defendant are true.

Regional Arbitration Court

This is where issues between Parties who have a contractual dispute or other disagreement which needs to be resolved are heard. This may include minor property crimes and other issues where the parties are willing and where a resolution would avoid Minor Court.

An elected Arbitrator will be presented with the dispute and render a binding decision. All materials presented to the Arbitrator by one party must also be presented or a correct copy provided, in the case of documents or media, to the other party and become public record.

vWhen materials presented are provably false, the person providing that material will be charged with a crime against the other party, the same as bearing false witness against a person in court.

This public Arbitration Court is a service and does not preclude Private Arbitration except when formal charges have been brought against one of the parties.

In this Court, both parties voluntarily solicit the Court for dispute resolution. Each may have their own Counsel.

A elected Public Arbitrator will hear the case. A Certified Fair Witness must be present to witness and record the hearing. No jury or Upholder of Rights is present. There is no fee to the parties involved to have a hearing.

It is designed to provide valid dispute resolution for such minor things as petty theft, neighbor disputes, car accidents and such. Non-criminal disputes. Disputes that are not worth the time or cost of Minor Court.

Regional Conductor of the Court

Elected for a six year term.

Elections for Conductor of the Court will be held on the standard three year cycle, with approximately half of the offices up on each cycle alternately.

There is no term limit.

The Conductor of the Court will be expected to keep up on legislation. It is not the role of Conductor of the Court to write ‘rulings’ or interpret law. Each case will come down to a vote of the Jury. It is the Jury who must interpret the law. But in Terran Society, laws will be short, simple and in clear language as per the Rights of the People.

The Conductor of the Court will wear a Colored Sash to denote their role and the type of court they are conducting. Jury member will also wear some indicator or their role.

Conductors of the Court will be given audience by the relevant Council of the People to make recommendations concerning modification or abolishment of existing law based on their practical experience and expertise.

Each Conductor of the Court will have authority to manage the court process including:

Determine in which type of court the case should be heard.

Advise the jury, clarify issues and answer their questions.

Dismiss a case if that is clearly the just course of action.

Abolish a Jury Ruling or Declare a mistrial for cause, then Re-Schedule a hearing as soon as is practical.

Have a Jury member or spectator removed from the hearing for misconduct.

Regional Rights of the People Upholder

This is an Elected office with elections held on the standard three year election cycle.

Has investigative authority and presents evidence to a Warrant Jury within the Local Area Government when a violation of Rights, which is a crime, occurs.

Is the watchdog of the Sheriff and other Executive Branch officials for the People to protect from abuse of office. May presents evidence for impeachment of a Local Area Government official to be removed from office to the legislative body.

Regional Public Arbitrator

This is an elected office with elections held on the standard three year election cycle.

There is no term limit.

The Public Arbitrator will wear a Colored Sash to denote their role as determined by the Legislature.

Presides over Arbitration Court, having authority to manage the process including:

Dismiss a case if determined to be the just course of action.

Have a Person removed from the hearing for misconduct.

Warrant Jury

A Warrant Jury will be empaneled from the normal Jury pool, on an as needed basis for the purpose of issuing Search Warrants and Arrest Warrants. It will consist of fourteen (14) Citizens. This process should not take long so no alternate jurors are necessary.

A Rights of the People Upholder convenes the Warrant Jury.

A Certified Fair Witness must be in attendance.

Evidence and testimony will be presented to the court by:

A Rights of the People Upholder on behalf of an injured party.

A person or persons designated by the injured party.

The injured person or persons themselves.

The jurors may directly question the witnesses.

If it appears insufficient information is presented, the jury should vote against issuing a warrant.

For a Warrant to be issued, It must be clearly based upon evidence and testimony with probable cause that Rights have been violated. It must be supported by oath or affirmation. It must particularly describe the place to be searched, and the persons or things to be seized.

If a Warrant is issued, it is handed over to the Executive Branch representative who is acting in a police role.

It will take at least 12 votes for approval to issue a Warrant for search and/or seizure or a Warrant for Arrest and/or for charges to be brought against a Member compelling them to appear in a Major or Minor Court.

The hearing may be conducted without a public audience, however, a written and/or recorded of the hearing must be made public soon after.

The accused has the Right to be informed of the nature and cause of the accusation.

The accused has the Right to be confronted with the witnesses against them in a Major or Minor Court.

Major and Minor Court procedure:

The accused has the Right to be confronted with the witnesses against him in a Major or Minor Court.

The accused shall have the right to a fair hearing by an impartial Jury.

The hearing shall be held as soon as is reasonable. If the accused is deprived of their liberty, the hearing shall have scheduling priority.

The accused has a right to compulsory process for obtaining witnesses who might aid in their defense.

The accused has the Right to the Assistance of Counsel for their defense. Their choice of Counsel shall not be limited to members of any organization, but be a person who is a member of this Society, is willing and is chosen by the accused for their defense.

Any evidence and witnesses must be made known to each side at least three working days before a hearing. Longer if deemed necessary by the Conductor of the Court.

The accused person may not be compelled to testify and may refuse to answer specific questions which may implicate themselves even when they do testify.

Anyone, in the court process, who is found to knowingly present false evidence or withhold relevant evidence should be charged with for a criminal offense equal to the severity of the charge brought against the accuse.

There will be opening and closing statements to the jury by the Rights of the People Upholder and the accused.

Each side will present evidence, argue their case and may call witnesses.

Witnesses called may be questioned by both sides alternately. The Conductor of the Court may also ask questions of the witnesses.

Active members of the Jury may submit written questions for witnesses to the Conductor of the Court.

When both sides have presented their case, the Jury will remove to a private room or area to deliberate with a Certified Fair Witness in attendance.

The Conductor of the Court may be called in by the jury to answer questions but may not attend the jury deliberations and must leave when the jury's questions are answered.

The Conductor of the Court may review the record made by the Certified Fair Witness of the jury deliberations and even ask objective questions regarding the conduct of the Jury. This is a check on Jury misconduct to help ensure a fair hearing.

The Jury would vote as to whether the Defendant is found in violation of the charges against them.

If the accusations are found to be true, the accused has the duty to make restitution to the injured party and may face a penalty as previously and narrowly determined by the Legislature.

Excessive, cruel and unusual punishments may not be inflicted, including maiming and physical abuse.

In all matters of dispute resolution, the objective is for healing of involved parties if possible.

In no case will fines be levied or property seized that does not go toward restitution. That is a court cannot charge for its services or have a financial incentive to convict.

Clearing a False Conviction

A Member of Terran Society may request the Rights of the People Upholder to convene a Warrant Jury for the purpose of reversing a Major or Minor Court Jury verdict.

Cases may be brought to the appropriate Court . In this matter, a Warrant Jury is presented evidence or testimony. This should include evidence or testimony not known or available in the original hearing. If the Jury determines a reasonable case can be made that a conviction has been made in error, Declaration for Hearing will be made to that effect. Any Citizen may request a Rights of the People Upholder to convene a Warrant Jury for this purpose. If they refuse, the next step is to present the information to a Local Area Government Representative who may convene a Warrant Jury.

If it is determined the refusal was an obstruction of justice, the Rights of the People Upholder is subject to impeachment and a Warrant may issued for their arrest.

If it is determined there was foul play which resulted in a false conviction, proper Warrants for search and seizure and arrest will be issued. This applies to all public officials and Citizens alike. The defending Person may be cleared of a conviction when it is determined to have been made in error by a Major or Minor Court, depending on which court the conviction was made.

Minor and Major Court Jury of Citizens

Citizens will serve on a Jury for a period of 90 to 120 days. The extended time is to account for ongoing hearing where a Juror has passed 90 days. They may be chosen by lottery from the pool of eligible Citizens as defined by the Legislature. All adult Citizens who are not serving in government or military are potentially eligible.

When one has served on a Jury, they should not have to do it again until ever other eligible person has served. For individuals who like to serve on a Jury, the Legislature should determine an appropriate interval before they are eligible to be in the Jury lottery.

If selected, they would take a leave of absence from their other activities. The Legislature will specifically define exceptions. These exception may include competency; age such as being too young or too senior to have to serve; Persons who have or are currently dealing with prior charges against them; Conflict of Interest; Persons in Hospital; and such.

Selected Jurors will be able to request to get out of duty, but must have a very good reason. The decision will be made by the Conductor of the Court. They will be returned to the Jury lottery pool.

The Shape of the Major and Minor Courts

The Jury will be arranged in 180° arc or semi-circle. Inside the arc, facing the Jury A semi-circle, where, from inside the arc, the Conductor of the Court sits to the Jury's left, at a modest desk. The Jury will sit in seats in a row making up the arc. Facing this arc, there will be two rectangular tables at a 45 degree angle to the center with a wide gap between them.

A seat in the middle facing the Jury and Conductor of the Court. This is where the witnesses and defendant will sit when they are providing testimony and/or being questioned.

On the left will be the Upholder of Rights who will present the case and attempt to prove the charges brought against the defendant. Injured parties will be at the table or near it as is practical.

On the right will be the Person who is charged and is defending and their Counsel who may also have staff assistants.

Arbitration Court

In this Court, both parties voluntarily solicit the Court for dispute resolution. The elected Public Arbitrator will preside. This is like a private arbitration today except it will not cost the parties involved to have a hearing. There is no, jury, Upholder of Rights or executive branch representative, but there is a Certified Fair Witness.

This certainly does not preclude private arbitration. It is designed to provide valid dispute resolution for such minor things as petty theft, neighbor disputes, car accidents and such. Non-criminal disputes. Disputes that are not worth the time or cost of Minor Court.

Terran Society Election Process

The standard election cycle for elected office is every three years for most offices and annually for the Council of Elders.

When an election is held off cycle, as in a recall election, the holding of the office expires on the next standard election cycle.

The election process shall last a minimum of 90 days and be facilitated by the Terran and Regional Office of Administrator.

Every member is free to participate in the vote including taking time off from their daily schedule if neccessary.

The process must be transparent with a genuine public forum where candidates can present, discuss, debate and be interviewed with public question and answer sessions.

No qualifying candidate may be excluded from the public forum and process.

Political Campaigns will be conducted in the Public Space and by the willing acts of Citizens who may speak, wear, write, publish, etc.

Candidates must disclose organizational membership from a minimum of seven years prior to present at the beginning of the process.

Objective criteria for elected office are merit, ability, reliability and skill.

Subjective criteria for elected office is trust they will conduct their official capacity with honor from the perspective of the People.

Party or political organizational affiliation is not necessary for a candidate to run for office.

Members must be able to vote using the ballot appropriate for their primary residence from within any other Region, this is also known as an absentee ballot.

The ballot process must include rank-choice-voting, also known as preferential voting.

A paper or other physical ballot has to be verified by the voter as correct, counted and kept on file for at least 10 years, which is longer than three elections cycles.

The General Election Process for the Terran Society and its Regions shall be defined by the Terran Legislature subject to approval by the Terran Executive Committee.

The detailed Election Process within each Region will be defined by the Regional Legislature and approved by the Regional Executive Committee.

The Regional and Terran Offices of Administration have a duty to ensure free and fair elections are implemented on schedule.

Language of Terran Society

The initial language of Terran Society is English. Terran Society documentation shall be translated into Korean and other widely spoken languages. The Korean Language shall be taught to all members of Terran Society with the goal of implementing Korean as our universal language.

Individuals Becoming Part of Terran Society

A process will be established for an individual to become a member of Terran Society.

There must be intent expressed by the individual to join Terran Society.

Facilities will be established to provide a health checkup, detoxification a clean healthy diet and a period of rest and recovery.

Individuals shall be taught the Rights of the People and the Terran Society Constitution.

A person may become a member of Terran Society when they have demonstrated comprehension of the Rights of the People and the Terran Society Constitution. The person shall make an oath to honor the Rights of the People and Constitution and to resolve disputes peacefully before a representative of the Executive Branch and a Certified Fair Witness.

New members of Terran Society shall be registered for services and an individual financial account setup. They shall be provide with an orientation and assistance to find a place in Terran Society and to ensure their basic needs are met.

Nation States Joining Terran Society

An existing nation, state, territory or province may decide to hold a general referendum and join the Terran Society en mass. An appeal to the Terran Office of the Ambassador shall be made by the nation state/territory/province. The Terran Ambassador shall have primary responsibility within the Terran Executive Committee to coordinate and arrange for a peaceful, smooth process.

A new Region may be established as per the Terran Constitution or an existing Region or Regions added to. Rules shall be established, through the Legislative Process, to guide and facilitate nation states joining Terran Society.

When a community is added to Terran Society, each individual still has the option to opt-out.

Children of a parent who is a member will be considered to be a member unless they officially renounce their membership when an adult.

Conversion of Businesses, Corporations and other Organizations

Terran Society Cooperatives are subject to regulation and taxation by Terran Society and/or the Region the cooperative is chartered within.

It is the role of the Administrators and Treasurers to work with the Legislatures to develop Cooperative organizational models to fit different needs. Cooperative organizational models approved by the legislative process will become available for use.

Systems will be developed by the Administrator and Treasurer to convert existing businesses, corporations and other organizational structures to Terran Society Cooperatives.

Specific conversion plans must be approved by the appropriate Office of Administrator and Treasurer. When all conditions have been met and upon approval, the conversion plan shall be implemented.

To complete the process the appropriate Terran or Regional Administrator and Treasurer working with the Treasurer and Staff of the transitioning organization shall conduct an inspection to determined that all essential conditions have been met and the news systems functioning correctly.

Terran Society shall not accept a fee from the transitioning organization for its role in the conversion.

Treaties

Treaties are agreements made between Terran Society and other civilizations.

Treaties shall be designed to promote peace, trade and travel.

Treaties shall be made as simple and short as possible and are subject to the Rights of the People.

The Terran Ambassador is responsible for negotiation and preparation of treaties with other civilizations.

The Office of Ambassador shall consult with the the Terran Legislative Councils during treaty negotiations.

When the Teran Ambassador determines a proposed treaty is ready for approval:

It is submitted for review by the Terran Executive Committee. A majority vote moves the proposed treaty to the Terran Council of the Regions.

A two thirds majority vote for approval is requried to advance the proposed treaty to the Council of the People.

The Council of the People advances the proposed treaty to general approval of the People with a majority vote for approval.

The vote for approval by the electorate does not have to fall on a standard annual or tri-annual election cycle. The final vote by the electorate of Terran Society for approval requires a two thirds majority. The final vote for approval shall be coordinated across each Region to take place on the same day, at least 14 days and not more than 90 days from the day of approval by the Council of the People.

Treaties are serious inter-civilization agreements. They should be stable and have long term effectiveness. It is important that the treaty have the support of a supermajority of our Society. Mutual defense agreements are to be avoided as they can lead to an unwanted, unneccessary war or serious conflict. Such situations can be fluid and decisions must be made based on all factors at the time of an incident.
